10-29-2001 I sent a check Fed Ex for $15,000
For my initial signup bonus I received 50% in free plays that were split up into three free plays of $2,500 each. I was told to roll the the total of both amounts 4x.
$15,000 + $7,500 x 4 = $90,000
11-8-01
I used my first free play. Bet taken by Erwin. Bulls ML + 1000
This bet lost.
11-10-01
I used my second free play. Bet taken by Ricky. NCAA football San Diego St. ML + 800
This bet lost.
11-13-01
I used my third free play. Bet taken by female clerk. Cavs ML + 1000
This bet won $25,000. After the bet $25,000 was put in my account, no questions asked and my account balance was at $54,700.
11-19-01
I called to request a payout as I had my action calculated at 100,000 now.
11-28-01
After waiting over a week and still no payout I called to see what was going on.
I spoke to Ron the GM and he told me I needed to bet the account 10x since I won a free play. While trying to get more explanation he has me talk to his boss........so then
I spoke to Joe Rizzo the "operations manager." Joe tells me that I have to give them 200k in action before I can take any money out, and then I can only take my account down to a balance of 25k. Then I must bet another 200k before I could get to the rest of my money.
At this point I'm like, well, what can I do. They are not willing to give me any of my money so I have to keep betting with them.
At this point I had my action calculated at over 122k but they recalculated and did it by the low end number on every bet and said I was at 45k in action.
12-17-01
I requested a payout for 9k and received it 4 days later. I had my action calculated at over 200k at this point.
12-18-01
I requested a payout for 9k and a few days later found out it had been rejected because they said my action was at 166,329. So I set out to get to 200k in action, by their calculation.
12-23-01
I called to request a payout, I had my action calculated at 207k now. I was informed that there would be no payouts until after Jan 1st.
1-2-02 My balance was at $79,315. I had my action at 266,999 and called to request a payout of 9k. I received it five days later.
1-3-02 I requested 9k and received it six days later.
1-7-02 I requested 9k and received it four days later.
1-8-02 I requested 9k and ............never received it. They had taken the balance from my account so on...
1-9-02 I requested 9k and ............never received it.
1-13-02 I had not received the checks yet so I called for the tracking number and then realized that 18k had been put back into my account and the previous two payouts were not processed. I called customer service and they sent me to speak with the GM - Bill Rice. Bill told me that Joe was upset because I hadn't bet in the past 10 days. I told Bill to let Joe know that I will start back betting once I get my money. I had planned on getting my balance down to around 25k, since this is what Joe and I had agreed on.
1-14-02 Bill Rice told me that Joe would talk to me after the Super Bowl and that he wanted me to keep betting. Later that day I spoke to Nick Jones and he said he couldn't understand why Joe would say one thing and not do it. Later in the day I spoke with Bill Rice again and he told me that Joe said to give them 400k in action and then I can take all my money out. I asked Bill to give me what my rollover was at now and he said he would call me back tomorrow and give it to me.
1-15-02 Bill Rice, the GM, said he did the count and I was at 280k. He said I can close my account and get all my money out once I get to 400k in action. At this time my account balance was $52,428 and that is the correct balance, which did include the $25,000 I won on the free play. Keep in mind that the 25k I won on the free play had been in my account since the day I won it. So there never was a problem with the 25k being included in my balance.
So I proceed to get the action.
5-20-02 I asked Nick Jones to see if I could get at least $7500 payout, and after no response to him from Joe Rizzo for over a month, finally Joe said "no."
5-25-02 I spoke to Nick Jones to see where I was on my action. I had it calculated at 341,060 by the way they count the low end, but he said it was at 328,979.
6-11-02 With my balance at $70,481 I had my wagering limits lowered on all sports to 3k. Previously it was 5k on baseball and 10k on football. My action at this point was 338,429.
So as I get close to yet another new action requirement level my limits are lowered once again.
6-28-02 I am at or close to my newest action requirement of 400k, so I ask Ryan to add it up for me.
7-1-02 I called Ryan to see if they have action added up yet, and he said he would try and get with Nick Jones tonight and get it straight.
7-3-02 I spoke with Ryan about the action. He informed me that Mike in bookmaking had added up the action and that it stood at 475k. Joe Rizzo was to be out of town until Monday July 8th and they will ask him to approve a payout then.
7-8-02 I spoke with Ryan, he said Joe should be there any day now, and that he would "hit him up for a payout" when he gets in.
7-10-02 I spoke with Ryan, he hoped to see Joe in the next few days.
7-12-02 I called for Nick Jones and left a message and he didn't return my call. I later called and spoke to Christian and he couldn't offer me any information.
7-13-05 I spoke with Ryan. He said Joe still not there and he tried to reach him one last time without success. He said he wasn't going to talk to me anymore because he was too frustrated with the ordeal. He said for me to call Joe on Wed. the 17th, he said he spoke to Joe's brother and was informed Joe was expected back on Wed the 17th.
7-17-02 I spoke with Ryan and he informed me that Joe was not there yet. I spoke to David Bell and he said "the owners won't be there until the 18th or 19th". I told him I'd been waiting almost two months for a payout and he said it shouldn't take that long, so now he was abreast of the situation.
7-18-02 Still trying to reach Joe Rizzo. I spoke to Tony in customer service and he said Joe was expected to come in on the 19th or 20th.
7-19-02 I spoke to Nick and he said Joe was expected to be there around noon on the 20th, and that he would be going on vacation for 20 days when Joe came back.
7-20-02
2:45 pm I called and spoke to Sandy - she said her boss Vicki said Joe will be there in one hour.
4:10 pm I called and spoke to Sandy, and Christian. Joe not there yet.
6:45 pm I called and spoke to Nick. He said Joe was in earlier and says "JOE SAID HE ISN'T GOING TO COUNT MY BASEBALL ACTION because I'm a middler." I proceeded to voice my displeasure with the new unjustified changes, and Nick said he would contact Joe.
7:45 pm I spoke with Ryan and he said Nick hadn't been able to get in touch with Joe yet.
7-21-02 I spoke with Lisa, Joe Rizzo not there. I gave her my name and number as I had given several people so many times before. Spoke to Arturo - head of bookmaking. He said he understood my frustration and this is the first he has heard of my situation but he was familier with my account number. Says he will get in contact with Joe today. No luck that day.
7-22-02 I spoke with Nick and he said he was going to the other building to speak to Joe. Later I left a message for Nick, but was able to speak to Robert and he said my action had been recounted to take out the baseball bets and that I was at 288k now. Robert said Joe would talk to me the first week of August.
This did not go over well with me, I was becoming frustrated with the numerous rule changes being imposed on me as I continued to reach my new action requirements. I was tired of having the requirements changed on a regular basis. I told Robert that I was tired of being lied to and being treated unfairly and that I wanted my money now. I said I would call them relentlessly until I received my money. Joe Rizzo later had Robert tell me that if it was worth losing 40k over then go ahead.
Later that same evening I spoke with Robert and he informed me that my account had been suspended until the first week of August, at which time Joe would speak to me. I told Robert that I would not be willing to wait that long and that them withholding my money was affecting me and my family.
Later that same evening I spoke to Nick Jones and he informed me that Joe said he would speak to me when he got back on August 5th. I told Nick that wasn't good enough and that I would explore other avenues.
At the time my account was suspended my balance was at $63,507.
7-23-02 I spoke to both Nick and Robert and they told me Joe wouldn't be back for atleast 18 days and they can't do anything to help. At 9:10 pm eastern I posted my entire story at the RX.
Later that evening I received a phone call from Joe Rizzo. He informed me that he had "more important" things to tend to at this time and could possibly talk to me on Friday. Said I hadn't given them "legitimate action."
7-24-02 I spoke with Shrink and Joe Rizzo. Joe Rizzo now said I shouldn't of got a free play since I won a lot of money from them. Joe said he would now pay what was in my account minus the 25k I won on the free play if I retracted the statement I made at the RX. Shrink said "you better take the money offered and run because you are fortunate to get any money since so many sportsbooks have gone under."
7-25-02 I posted at the RX what Joe Rizzo told me to post in their exact wording in order to get my money that was offered at the time.
8-1-02 I spoke with David Bell and he informed me that he was going to send me an agreement to sign before I could get any of my money.
8-13-02 I received 8 different checks that totalled $38,507, with 6 of the checks postdated up to 6 weeks. The checks were written off a Mexican bank and took 30 days to clear once they were deposited. So it was over 10 weeks from the time I received the money from the last check I deposited.
I am still seeking the $25,000 that I feel is owed to me.
